Terms of use

1. Purpose

These terms of use govern access to and use of the Heedsy service available at heedsy.com, published by Romain Lourenco, sole trader (micro-entreprise), trade name Heedsy, Aramon 30390, France (contact@heedsy.com).

Heedsy is an online service that lets local merchants and professionals create and publish a business page, present their activity (hours, contacts, links, photos), collect ratings, and — depending on the plan — add modules (forms, PDF documents, gallery), view audience statistics and appear on the public Heedsy map.

Creating an account or using the service constitutes acceptance of these terms without reservation.

2. Definitions

• User: any person who creates a Heedsy account (merchant or professional).
• Visitor: any person viewing a published business page.
• Business page: a public page created via Heedsy and associated with a business.

3. Access and account

Access to the dashboard requires an account. Sign-up uses an email address and password, or a sign-in link sent by email. The User agrees to provide accurate information and keep their credentials confidential.

From their workspace (settings), the User can notably manage their password and subscription. Heedsy may suspend or delete an account in case of abusive, fraudulent use, or use contrary to these terms or applicable law.

4. Service description

Depending on the plan subscribed, the service may notably allow:

• creating, editing and publishing a business page (business presentation, hours, contacts, social links, custom links);
• generating a QR code pointing to the page;
• collecting and displaying ratings left by Visitors (feature that can be enabled by the User);
• viewing first-party audience statistics (available periods depending on the plan);
• appearing on the public Heedsy map (free-plan accounts remain visible there; paid plans may opt out);
• on paid plans: adding modules (forms, PDF documents, photo gallery), removing Heedsy branding on the page and/or QR code, and higher limits (links, statistics).

The exact features of each plan are described on the site (pricing page and dashboard). Heedsy may evolve the service and plans; new features may be announced as “coming soon” before they become available.

5. Plans and payment

Heedsy offers a free plan (Starter) and a paid plan (Pro). Prices, billing period (monthly or annual) and feature details are shown on the site at checkout.

Payments are processed by Stripe. Heedsy does not store card numbers. Unless otherwise stated, the Pro subscription is without commitment and may be cancelled at any time by the User from their account (settings → manage subscription, via the Stripe portal: payment method, invoices and cancellation).

In case of non-payment, end of subscription or return to the free plan, access to paid features may be limited or suspended (for example modules hidden on the public page, Heedsy branding shown again, free-plan limits reapplied). Configured content may be kept in the database so it can be reused if the User subscribes again, within the technical limits of the service.

6. User obligations

The User agrees in particular to:

• use the service in accordance with the law and these terms, without infringing third-party rights;
• be responsible for content published on their page (texts, images, PDF documents, links, contact information, module configuration);
• not publish unlawful, misleading, defamatory content, or content that infringes intellectual property rights;
• for forms and any data collection from Visitors: define appropriate fields, inform the individuals concerned, and process collected data in accordance with the GDPR and applicable law (the User is generally the controller for that data — see the privacy policy).

7. Content and ownership

Elements of the Heedsy service (brand, interface, software, editorial site content) remain the property of Heedsy or its licensors.

Content published by the User remains their property. The User grants Heedsy a non-exclusive, worldwide, royalty-free licence limited to what is needed to host, display and operate the service (including technical backup, public display of the page and, where applicable, display on the public map).

Heedsy does not exercise prior editorial moderation of business-page content, without prejudice to its right to suspend an account in case of abuse.

8. Availability and liability

Heedsy strives to keep the service available and secure, without guaranteeing uninterrupted or error-free operation. Maintenance or interruptions may occur.

To the extent permitted by law, Heedsy shall not be liable for indirect damages, loss of revenue, or consequences arising from content published by Users, ratings left by Visitors, or exchanges between Users and Visitors (including via forms).

The User remains solely responsible for their relationship with Visitors (form replies, commercial services, legal notices specific to their activity, etc.).

9. Personal data

Personal data processing is described in the privacy policy, which forms part of the framework applicable to the service. The use of audience measurement cookies (Google Analytics) is subject to your consent, as described in that policy.

10. Termination

Paid subscription: the User may cancel their subscription at any time from their account, via settings (“Manage my subscription”), which opens the Stripe portal. Cancellation takes effect according to the terms shown in that portal (generally at the end of the period already paid).

Stopping use and account deletion: the User may stop using the service at any time (for example by unpublishing their page or returning to the free plan). To request deletion of their account and related data, they contact contact@heedsy.com.

Heedsy may terminate or suspend access in case of breach of these terms or for a legitimate reason (security, abuse, legal obligation).

11. Changes

Heedsy may update these terms to reflect changes to the service or the law. The update date appears at the top of this page. Continued use of the service after a change constitutes acceptance of the new terms, subject to any mandatory rules that apply.

12. Governing law

These terms are governed by French law. In the event of a dispute, and failing an amicable resolution, French courts shall have exclusive jurisdiction, subject to any mandatory consumer-protection rules that may apply.
